Yes, this is what it says in the rules, BUT it should be common sense that you are NOT allowed to drive over somebody just because he is on the road. Would you do that in real life? Oh look - somebody walking on the street, lets' drive over him and kill him for that.
It is only not your fault if it happens by accident, lets say somebody is walking in the middle of the tunnel on the street and you did not see him because it's so dark in there.
