He wasn't exactly farming it from what I see in the evidence.
For all we know he just had a contraband stash which he emptied once in a while when he had no customers.
(It looks like this is the case, seeing how as the contraband is at 2/5.)
I don't think this is sufficient evidence to get him banned.
