The accused violated the following rules

• [3.4] You must follow FearRP by acting afraid of threatening situations that affect your own or accomplices' lives. To initiate FearRP have a weapon out and give out orders (text or voice).
  
• [3.4a] You cannot attack or draw a weapon on a person who has a gun pointed at you (as well as a stun gun or melee weapon at striking distance).
  

After reviewing the provided evidence I think you are too petty when saying you're not under FearRP when he shakes his head, you are still expected to act afraid and have your own life in consideration which is regulated by rule 3.4. You were still under FearRP.

The accused will recieve the following punishment

3h Weapons blacklist

The reason the blacklist is 3h is because you have a history of being trigger happy which as resulted in multiple cases of RDM, FailRP and cases where violence has not been used as a last option.
