Summary: So we raided him and wanted to arrest him because he stole a policecar, his friend came out of nowhere and started to shoot us. After we killed his friend John Jong breaks FearRP and drives away with another friend.

Still nobody tried to kill him and we can't do anything if he runs infront of our guns. After we killed you no shots were fired and he had to follow FearRP

This depends, if the person intends to kill you then no. However if they stop shooting you and/or tranq you and they have you cornered, you have to follow FearRP.
We didn't intend to kill you and stopped shooting after your friend had died
